Former Delhi Chief Minister Arvind Kejriwal has approached the Delhi High Court in the excise policy case. He has questioned the CBI’s challenge to the trial court order that discharged him and other accused.
Former Deputy Chief Minister Manish Sisodia has also challenged the CBI’s revision petition. Both leaders have sought its dismissal.
Kejriwal questions CBI’s quick move
During the hearing, Kejriwal’s lawyer raised questions about how quickly the CBI approached the Delhi High Court.
Senior advocate Ramesh Gupta, appearing for Kejriwal, argued that the agency filed its challenge within around four hours of receiving the trial court’s detailed order.
The defence questioned whether the CBI had enough time to properly study the order before challenging it.
It also questioned whether the agency could have reviewed the judgment, sought legal advice and prepared its petition within such a short period.
However, these are arguments made by Kejriwal’s legal team. The court has not accepted them as established findings.
Kejriwal’s counsel further argued that the CBI filed its petition without properly considering the reasoning given by the trial court.
Meanwhile, the CBI has challenged the lower court’s decision. The agency argues that the trial court made errors while assessing the prosecution material.
What did the trial court decide?
In February 2026, Delhi’s Rouse Avenue Court discharged 23 accused, including Arvind Kejriwal and Manish Sisodia, in the CBI case linked to the now-scrapped Delhi excise policy.
The court concluded that the material presented by the CBI was not sufficient to establish a prima facie case for framing charges.
Importantly, the decision was a discharge at the pre-trial stage. It was not an acquittal after a completed criminal trial.
The CBI later approached the Delhi High Court to challenge the order.
The Arvind Kejriwal Delhi High Court case now remains pending. The High Court will decide whether the discharge order should stand or whether further proceedings are required.
