The Lok Sabha on Monday passed the Supreme Court Judges Amendment Bill, 2026, paving the way for an increase in the sanctioned strength of Supreme Court judges. The Bill raises the number of judges from 33 to 37, excluding the Chief Justice of India (CJI). The move aims to improve the functioning of the country’s highest court and reduce the growing backlog of pending cases.

Supreme Court Judges Amendment Bill Passed in Lok Sabha

The Bill was passed through a voice vote during the Monsoon Session of Parliament. It replaces the ordinance issued by the Centre earlier this year to increase the strength of Supreme Court judges.

With this amendment, the total strength of the Supreme Court, including the Chief Justice of India, will rise from 34 to 38 judges.

Why the Government Increased the Number of Judges

The Centre said the decision will help the Supreme Court deal with its rising workload. Thousands of cases remain pending before the apex court.

By appointing four additional judges, the government expects faster disposal of cases and quicker delivery of justice. The move is also expected to improve the overall efficiency of the judicial system.

What the Bill Changes

The amendment revises the Supreme Court (Number of Judges) Act, 1956. It increases the sanctioned strength of judges from 33 to 37, excluding the Chief Justice of India.

The Bill does not automatically appoint new judges. It only increases the number of sanctioned posts. Appointments will continue to follow the existing constitutional process.

Why This Matters

India’s Supreme Court hears constitutional matters, major appeals and cases of national importance. A higher number of judges is expected to reduce delays and improve access to justice.

Legal experts have long argued that increasing judicial strength is one of the steps needed to tackle the growing burden of pending cases. However, many also say that vacancies in High Courts and lower courts must be filled to improve the justice system further.

What Happens Next?

After clearing the Lok Sabha, the Bill will move through the remaining parliamentary process before becoming law. Once implemented, the Supreme Court will have a sanctioned strength of 38 judges, including the Chief Justice of India, making it better equipped to handle its increasing workload.
